1. Agreement to Terms

By accessing this website or engaging Speck Creations for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

Speck Creations provides web development, software development, mobile app development, e-commerce solutions, SEO, digital marketing, graphic design, and website maintenance services as described on our website.

3. Project Agreements

Each project is governed by a separate proposal or contract that outlines the specific scope, deliverables, timeline, and pricing. These Terms of Service supplement any project-specific agreement.

4. Payment Terms

• Deposit: A 50% deposit is required before work begins
• Final payment: The remaining balance is due upon project completion, prior to final delivery of all assets
• Milestone payments: For projects exceeding $5,000, milestone-based payment schedules are available and will be outlined in the project agreement

All prices are quoted in the currency agreed upon in the project proposal unless otherwise stated. Invoices are due within 14 days of issuance. Late payments may be subject to a 2% monthly interest charge on the outstanding balance.

5. Intellectual Property

Client ownership: Upon receipt of full payment, the client owns all final deliverables including designs, code, and content created specifically for their project.

Portfolio rights: Speck Creations retains the right to display completed work in our portfolio and marketing materials, unless otherwise agreed in writing.

Pre-existing materials: Any pre-existing tools, frameworks, or code libraries used in the project remain the property of Speck Creations or their respective owners.

6. Client Responsibilities

Clients are expected to provide timely feedback, content, and approvals as needed during the project. Delays caused by the client may affect the project timeline and may incur additional charges if significant rework is required.

7. Revisions

The number of revision rounds is specified in each project agreement. Additional revisions beyond the agreed scope will be billed at our standard hourly rate, communicated in advance.

8. Limitation of Liability

Speck Creations shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability shall not exceed the amount paid by the client for the specific project in question.

9. Termination

Either party may terminate a project with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date.

10. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
